These Terms and Conditions (“Terms”) are published by Oleant EV Technology (“Oleant EV”, “we”, “us”, or “our”). Registered correspondence address: #3rd Cross, Nethajinagar, Tumkur Road, T. Dasarahalli, Bengaluru – 560057, India. These Terms govern access to and use of our website (the “Platform”) and the online booking of vehicles and related services. By continuing to browse, access, register, transact or otherwise use the Platform, you (“User”, “you”, “your”) agree to be bound by these Terms.

1. Definitions

• Applicable Laws: All laws, statutes, ordinances, regulations, guidelines, policies and other pronouncements having the force of law in India.
• Data Protection Law: Any data protection, data security or privacy law in force in India, including the Information Technology Act, 2000 and rules thereunder.
• Government Authority: Any governmental, statutory or regulatory authority, ministry, department, commission, board, tribunal or court within India.
• Bank Account: The designated bank account(s) of Oleant EV for receiving payments, as notified by us from time to time.
• Content: All information or data provided by Oleant EV on the Platform including text, graphics, images, photos, software, audio, video and documents.
• Intellectual Property Rights / IP Rights: All rights, title and interest in patents, copyrights (including moral rights), trademarks, designs, trade secrets and similar rights worldwide, including applications, renewals and rights to sue for infringement.
• Intellectual Property / IP: Ideas, inventions, designs, works of authorship, source materials, documentation, databases, software, algorithms, drawings and other proprietary information whether copyrightable or patentable.
• Misuse: Any act inconsistent with the spirit of these Terms even if not expressly prohibited herein.
• Loss: All direct losses, damages, liabilities, costs (including legal fees), expenses, penalties, claims and proceedings.
• Personal Data: Any data relating to an identified or identifiable natural person, including names, contact details, identifiers and online identifiers.
• Sensitive Personal Data or Information: Information as defined under applicable Indian law, including financial information, passwords, health data, biometric information, etc.
• Platform: Our website accessible at the domain we notify (and related pages) and any website or application powered by Oleant EV. It excludes third‑party sites linked from the Platform.
• User Content: Any content uploaded, posted, sent, received or stored on/through the Platform by the User.
• Vehicle: Electric two/three‑wheelers or buses listed by Oleant EV on the Platform for booking by Users.

2. Eligibility

By using the Platform, you represent that you are at least 18 years of age and competent to contract under the Indian Contract Act, 1872. We may suspend or terminate access if ineligible use is detected.

3. Acceptance of Terms & Related Policies

Your access or use of the Platform constitutes acceptance of these Terms as well as our Privacy Policy, product disclaimers and any additional agreements you may enter into with Oleant EV. By using the Platform, you agree that Oleant EV may collect and use your Personal Data in accordance with our Privacy Policy.

4. Booking

Placing a booking on the Platform expresses your intention to purchase the selected Vehicle and your agreement to these Terms. Successful booking is subject to availability of the chosen Vehicle and compliance with Applicable Laws and Oleant EV policies.

5. Payment of Booking Amount

For online booking, you may be required to pay a booking amount (“Booking Amount”) through third‑party payment gateways (e.g., Razorpay/Paytm). The Booking Amount confirms your booking upon successful transaction and is adjustable against the final sale price. Oleant EV is not responsible for gateway‑related payment issues. Acceptance of the Booking occurs only when Oleant EV notifies you via SMS/email.

6. Price of the Vehicle

Unless otherwise stated, prices displayed on the Platform are indicative ex‑showroom prices and may vary at the time of purchase. On‑road price is subject to taxes, registration, insurance and accessories. The prevailing price on the date of intimation of final payment shall be treated as the sale price. Balance amounts (after adjusting the Booking Amount) are payable at the dealer location notified by Oleant EV.

7. Financing Option

Where financing is offered via third‑party financiers (banks/NBFCs), you will be governed by the financier’s terms. Additional charges (processing fees, interest, GST, etc.) may apply as per financier policy. Oleant EV is not responsible for actions or omissions of the financier.

8. Delivery

Upon receipt of full sale consideration and completion of documentation, we will communicate an estimated delivery period and make commercially reasonable efforts to deliver within that period. Delivery timelines are subject to stock and operational constraints and may follow a  first‑come‑first‑served basis. In case of delay, you may cancel and claim refund of the Booking Amount in accordance with Clause .

9. Cancellation & Refund

You may request cancellation of a booking prior to payment of the full sale price. Upon approval, the Booking Amount will be refunded to the original payment source within a reasonable period (subject to payment provider timelines). Once full payment is made and the sale is complete, cancellations/refunds are not permitted.

10. Assignment / Transfer

Your booking is personal to you and may not be assigned or transferred to any third party.

11. Collection of Information

We may require certain information and documents for processing your booking, including KYC and regulatory requirements. You warrant that provided information is true, complete and accurate, and you will promptly notify changes. Collection, storage and use of Personal Data are governed by our Privacy Policy.

12. Terms for Purchase

These Terms apply to bookings. The actual purchase is additionally governed by Oleant EV’s purchase terms, invoices, warranty policies and any dealership‑specific terms, as updated from time to time.

13. Intellectual Property Rights & Restrictions

All materials on the Platform—including text, designs, graphics, images, software, audio/video clips and the overall look‑and‑feel—are owned by or licensed to Oleant EV and protected by IP laws. Except for a single personal, non‑commercial copy (with notices intact), you must not copy, reproduce, modify, distribute, publicly display, or create derivative works from any material without prior written consent.

14. Confidentiality

You may receive non‑public information relating to Oleant EV or its Vehicles. You shall keep such information confidential, use it solely for the intended purpose, and not disclose it to third parties without written permission.

15. Indemnity

You agree to indemnify and hold harmless Oleant EV, its affiliates, officers, directors, employees and agents from any claims, losses, liabilities, costs and expenses arising out of your breach of these Terms, violation of law, or infringement of third‑party rights.

16. Remedies

Termination of these Terms shall not limit Oleant EV’s right to pursue any other remedies available at law or in equity.

17. Disclaimers

Specifications, features and design of Vehicles may be modified without prior notice as part of continuous improvement. The Platform and its content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non‑infringement. Oleant EV does not warrant uninterrupted or error‑free operation of the Platform. Accessing/downloading content is at your own risk.

18. Limitation of Liability

To the maximum extent permitted by Applicable Laws, Oleant EV shall not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, business, goodwill or profits, arising out of or in connection with the Platform, bookings or delivery delays.

19. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Courts at Bengaluru, Karnataka shall have exclusive jurisdiction over disputes arising herefrom.
